Duration of Validity:

The offers available on this site are only valid during they are online according to dates indicated and they are only available on the website (www.foiegras-groliere.com). These offers are not available in our stores and in the stores and markets where Foie Gras Grolière products are sold.

 

Availability of products:

The products offered on this site are valid within the limits of available stocks. In the case of the unavailability of a product, a customer can ask to be informed by email when the product becomes available again to be ordered on the site. If a product is said to be out of stock after a customer has already completed an order. In this case the customer will be informed by telephone or by email within 48 hours (excluding weekends and bank holidays). In this case, the Foie Gras Grolière association will either refund the customer or replace the product with an equivalent product (according to what the customer wants) in order to not delay the order.

 

Geographic limitation:

Products that must be kept cold (half-baked products) can only be sold within France and the European Union (Germany, Austria, Belgium, Bulgaria, Denmark, Spain, Estonia, Finland, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Poland, Portugal, the Czech Republic, Romania, Slovakia, Slovenia, Sweden, the Vatican).

 

Tariff Policy of the Foie Gras Grolière business:

 

The prices displayed in euros include all taxes for products purchased by individuals and excluding taxes for professionals. They are guaranteed (other than if the VTA rate is changed during the session). The price displayed doesn’t include transportation fees and packaging. The amount of these fees will be displayed before you finalise any order on the site. These articles will be billed with all tariffs when the order is finalised by the customer.

 

The total payment of the order must be shown during the order. The Foie Gras Grolière association reserves the ownership rights of these products until the payment for the order is received and completed.

 

For fresh truffles and raw Foie Gras, the prices fluctuate according throughout the year.

 

VAT:

This is regulated by the European Union. Deliveries to European Union member countries will include French VTA.

Deliveries outside the EU: any custom fees incurred will be paid by the customer.

We do not pay custom fees for deliveries.

It is the responsibility of the customer to inform the local authorities of any eventual import limits on products before the order is place.

 Modes of payment on www.foiegras-groliere.com

The Foie Gras Grolière accepts payment by debit and credit card (VISA, Mastercard, American Express..etc) via Paybox and Paypal.

An order can only be processed if the centre of payment concerned has allowed the payment.

In case of refusal of one of the parties concerned the order cannot be completed and the customer will be informed by email, phone or letter.

 

Foie Gras Grolière reserves the right to refuse any order placed by a customer with whom their exists any dispute (notably concerning payment).

Foie Gras Grolière also accepts payments by wire transfer, checks, Kadéos checks (for order destined for abroad or non French mainland French departments checks aren’t accepted).

For debit cards, the order will be treated after the payment is received. The delay of the treatment of the order will be longer therefore. Checks must be addressed to Foie Gras Grolière sent to the following adress : Service Internet - BP 24 –24260 LE BUGUE.

In the case of late payments, the date of lapse will be communication. This will engage the payment of bills even those that aren’t in arrears.

The customer is will be in debt of all payment rights with a months delay at a rate equal to 1.5%, the legal interest rates, due for payment for the day following the finalisation.

Resolution:

In absence of a payment for a customer, on the agreed deadline and if a month after a formal notice remains unpaid, the sale will be resolved using the law if the merchant decides it. The amount in interest and damages, according the penal clause, is around 20% of the unpaid sum.

Fixed compensation (VAT exempt)

According to the Decree n° 2012-1115 of the 2nd of October 2012, fixing the amount of fixed compensation for the fees of recovering the cost of commercial transactions are outlined in article L 441-6 of the Business code: all invoices paid after the agreed deadline will incur a fixed penalty of 40 euros per billing.

 

Security of financial transactions:

 

Bank card payment using our Paybox system have a TSL certificate.

 

The link between buyer and the Paybox server is established in http, a secure protocol that encyprts all information that is exchanged.

 

At any moment, the banking details of a customer aren’t entirely displayed. This protection the data exchanged over the interest and guarantees that the card number of the buy will never be clearly displays (only ever displays a third of the number) during to the secure Paybox sever.

 

The Foie Gras Grolière has also put in place a 3D secure payment system for banking cards.

 

Order validation:

 

Once a customer has pressed the ‘Submit’ button at the end of the order process, the customer therefore has declared their full acceptation of the terms and conditions of sales.

 

With the validation of the order, the customer has declared that they recognised that this an order with payment obligation.

 

Data saved on www.foiegras-groliere.com is proof of the entirety of transactions between customers and the business.

 

This data saved by the payment system is also proof of financial transaction.

 

We make sure we use the best conditions of packing and speed in processing our deliveries.

 

The availability of our products depends on the stock we have. If a stock is out of stock, our site will inform you of the delay until the product is back in stock. If you are interested by this product, you can ask to be informed by email when the product is back in stock. When the product is back in stock we will inform you by email.

 

Our isothermal packaging for the half baked Foie Gras limits the variation of temperature whilst it is being transported.

 

Our carriers : TNT, So Colissimo and DB Schenker (for the heaviest packages including wine).

 

1 – Transport fees for deliveries to main land France :

 

For individuals:

For professionals:

 

For orders worth equal to or over 400 euros  up to 800 euros (without tax) the delivery fee is 20 euros.

 

We offer free delivery for orders worth over 800 euros

 

We do demand that for professionals the first order is worth over 800 euros (without tax)

 

2 – Delays in the processing of orders for main land France

 

Orders are send within 24 hours of being completed on line.

 

Orders received after 11h on Friday, or order placed on Saturday or Sunday will be sent on Monday.

 

We do not send orders during the weekend or bank holidays.

 

Choice of delivery date :

 

It is possible to choose a date for our delivery on our site – on the page dedicated to delivery. (weekends and bank holidays are excluded from this,

 

TNT is the only of our carriers that offers the possibility to choose Saturday morning delivery.

 

Delivery time:

 

Our delivery date are indicated in working days, starting from the day the order is processed (excluding particular transport problems, strikes or adverse weather).

For TNT : delivery in 24 hours between 8h-13h for half-baked products, and urgent orders (for both individuals and businesses) at :

-       At the parcel office of your choice (this means you don’t have to wait around for your delivery – this type of delivery is only available on a Saturday morning if it is specifically asked for

-       At your homes (delivery is possible Saturday morning but the date cannot be guaranteed)

3 – Delivery times for orders destined abroad or in non mainland France French departments

 

These orders will be sent 24h after they are processed online

 

Orders processed after 11am on Friday, or on Saturdays and Sundays will be sent on Monday.

 

We do not send products at the weekend or bank holidays.

 

Foie Gras Grolière and our web site foie-gras-groliere.com reserves the right to refuse an order destined at a country in a unstable economic or political situation that doesn’t allow these products to be safely and securely delivered.

 

For order destined abroad our website will calculate the delivery fees automatically before your order is processed depending on the weight of the product and the destination country.

 

We do not send wine abroad.

Delivery within 24h between 8am-18pm: for express deliveries (with half baked Foie Gras, dried duck, fresh truffles: those products in isothermal packaging) for deliveries to the following countries: Germany, Austria, Belgium, Bulgaria, Denmark, Spain, Estonia, Finland, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Poland, Portugal, the Czech Republic, Romania, Slovakia, Slovenia, Sweden, the Vatican.

 


Colissimo Expert International: delivery between 3/5 working days for deliveries of our preserves

 

DB Schenker messenger: delivery between 3/6 working days for heavy packages of preserves.

 

For all other foreign countries and non mainland France French departments:

 

Colissimo Expert International: Delivery between 4-10 working days, depending on the region of the destination country.

 

We do not take any responsibility for delivery times that are not met for deliveries abroad. The estimated delivery dates are indicative and not contractual.

At the moment of the delivery, any risks to the products received by the customer are transferred to the customer.

 

The person to whom the product is destined must process proof of the right delivery number in front of the deliverer. If this is the case, the deliverer will right there remarks concerning the delivery and reception of the product before singing and confirming their concerns by tracked letter within 48h to the business in order to be able to claim damages. The absence of this means that any claim is invalid.

If the delivery address saved on the website is incorrect, the transport costs to return the product and re-send it, the customer will be billed for these costs.

 

VTA (Value added tax) – Importation fees and custom fees

 

This is regulated by the European Union. Deliveries to European Union member countries will include French VTA.

Deliveries outside the EU: any custom fees incurred will be paid by the customer.

We do not pay custom fees for deliveries.

It is the responsibility of the customer to inform the local authorities of any eventual import limits on products before the order is place.

 Retraction rights:

In accordance with the legal conditions (Civil and Consumption Code), the products provided by Foie Gras Grolière benefit from legal guarantee against hidden defects and a legal guarantee of conformity.

We ask that customers state, if possible, their customer reference number of the reference of the order. No returns will be accepted by Foie Gras Grolière without a without having a prior written notification from the client. Product being returned must be addressed to the following address:

The following rules apply for all products returned:

If the product is returned because the client isn’t satisfied (exercising the right of retraction): the Foie Gras Grolière business will provide a refund for the returned product and the delivery costs (but the return delivery costs will be charged to the customer).

If the product is returned for a reason that suggests the culpability of Foie Gras Grolière, the business will refund the product, the delivery charges and the costs of return delivery.

 

In the  case of a refund of an order or any transport cost, these fees will be refunded to the client in the form of a cheque.

The refund will take place in a delay less than 14 days after the product has been received by Foie Gras Grolière.

No refunds or replacements will be given for products that have exceeded their use by date. The product must be returned, in the packaging and original state in which they were sent. All orders that are returned incomplete and damaged will not be accepted.

Retraction rights do not apply to the half-baked products or dried duck.

Conservation of products – grievance

The half baked duck Foie Gras must be consumed and stored according to the conditions mentioned on the packaging (between 1/3 degrees) in the fridge. The customer must respect the use by dates displayed on the packaging. In any case, Foie Gras Grolière does not accept any responsibility if these measures not follow the regulations in place in the destination country (for orders going abroad).

The half baked products are only guaranteed for 4 months after the billing date, but they must be kept in the fridge between 1/3 degrees. The customer must respect the use by dates on the packaging. Half-baked products cannot be returned without prior written notice.

For the conserves, they are guaranteed for a year after the billing date. But they can be kept for several months in a dry place that doesn’t exceed a temperature of 25 degrees. The business will refund or replace, depending on the customer’s choice, overflowing or damaged packages (that are still within their guarantee). However they cannot be returned if they are dented or rusty.

In all cases, the product must be consumed with the time period displayed on the packaging. It is important to carefully read the labels as they will give customers all the details they need such as preparation, conservation and the presentation of products.

Settling disputes:

All dispute concerning the application of the terms and conditions of sales and all disputes in general between Foie Gras Grolière, its clients and its suppliers even in the case of buyer’s warranty claims or a several defendants will be placed in under the juristriction of the Bergerac Tribunal.

 

Transferring property:

The transferal of property will not take place until the full the payment has been received in its entirety and any eventual sums due from the seller, regardless of the delivery date – in accordance with the conditions of law 80-335 of the 12th of May 1980.
